Bottango PRIVACY NOTICE

Bottango, LLC (“Bottango,” “we” or “us”) provides this Privacy Notice to explain our practices relating to our collection, use, processing and sharing of information we collect from you or that you may provide to Bottango whey you visit our website or otherwise interact with us. This Privacy Notice is incorporated into and forms a part of our Terms of Use (https://www.bottango.com/terms).

Capitalized terms used in this Privacy Notice but not defined have the definitions assigned to them in the Bottango Terms of Use. This Privacy Notice applies to information that Bottango collects: on or through the Bottango website (https://bottango.com) (the “Site”); in email, text, Discord, and other electronic communications between you and Bottango; through software applications you download through the Site (“Software”); and when you interact with our advertising on third-party websites and services (collectively, “Services”).Please read this Privacy Notice carefully. By using our Services, you agree to the terms of this Privacy Notice. If you do not agree to the terms of this Privacy Notice, do not access or use the Site or engage in the actions described above. 

  1. INFORMATION COLLECTED
    1. Personal Data. We may collect certain information that, in itself, personally identifies you or that can be used in conjunction with other information to identify you, such as your name, postal address, email address, telephone number, name of the company you work for, your job title. The term “Personal Data” may also include, where applicable, your responses to surveys or forms, and other information that you choose to submit when you communicate with us.
    2. Device, Log and Similar Data. We may collect information about your device or usage of our Services. This information may include, but is not limited to, your Internet Protocol (IP) address, internet service provider or mobile carrier, operating system, browser type, device type, location, language, referring website, application or ad, log files, time and date stamps, pages and files on the Site that you view, links you click on, and crash or bug reports with error causing or non-executing code texts and functions. Some of this information, either alone or in connection with other information we collect, could personally identify you.
    3. Shopify. The Site is hosted by Shopify. Shopify collects information when you visit this Site, including: information about your browser, network and device; web pages you visited prior to coming to the Site; and your IP address. Shopify uses the Personal Data collected from you in connection with its provision of services to us—for example, to run the Site, and to protect and improve its platform and services).
    4. Google Analytics. This Site uses Google Analytics to analyze the performance of the Site and improve its Services. Google Analytics collects information when you visit this Site, including: information about your browser, network and device; web pages you visited prior to coming to the Site; and an anonymized form of your IP address. Google Analytics collects data using technologies such as cookies or similar technologies to gather information about your activities on this Site to create advertising for us based on your browsing activities and interests.
    5. Shopify. Our Site uses Shopify to provide shopping functionalities to its users. Shopify collects Personal Data such as payment information when you enter it into the Services in connection with a transaction in order to process payments for our products.
  2. HOW WE COLLECT INFORMATION
    1. Functional and required cookies cannot be disabled, as they allow Shopify to securely serve the Site to you.
    2. Shopify’s analytics and performance cookies are used on the Site, as further described below, only when you acknowledge a cookie banner on our Site. We use analytics cookies to view Site traffic, activity, and other usage data.
    1. Communications. We collect information, which may include Personal Data, when you: contact us to request information about our products; request customer support; use a “contact us” or similar feature; send us bug reports, crash reports or feedback; or otherwise communicate with us (including without limitation through email and social media platforms such Facebook).
    2. Subscriptions and Responses. We collect information, which may include Personal Data, when you subscribe to receive newsletters or other periodic updates from us, respond to our questions or surveys, post reviews of our products on the Site, or post to our Discord channel as well as any other discussion boards or forums that we may host.
    3. Interactions with the Site; Cookies. We collect information, which includes device, log and similar data, and may include Personal Data, automatically when you navigate or interact with our Services or our advertisements on third-party sites, or if you opt-in to enable automatic crash and bug reports for the Software. Bottango, and third parties providing services to Bottango, utilize certain technologies to recognize you when you use the Services, track your interactions with the Services, and personalize your experience. These technologies include devices such as cookies, web beacons, pixels and similar devices. Cookies are small data files we transfer to your computer hard drive. We utilize some cookies that remain on your computer after you leave the Site so that we can recognize you when you return. We also utilize session cookies to enable certain features of the Site, to better understand how users interact with the Services and monitor use of the Services and web traffic to the Site. Session cookies are deleted from your computer when you log off from the Site and close your browser. You maintain control over some of the information we collect through the use of cookies, and you can set your preferences regarding the use of cookies through your browser settings. Unless you consent to non-essential cookies, only cookies that are essential for providing the Site to you (such as cookies for security, verification of identity and network management) will be deployed when you visit the Site. If you choose not to accept cookies, you may not be able to access portions of the Site or use certain functions of the Services. It helps us to improve our Site and to deliver better and more personalized Services.
    4. Our hosting service provider, Shopify, uses cookies in connection with hosting the Site. For information about viewing the cookies placed on your device, visit: Shopify Cookie Policy.
    5. Our analytics provider, Google Analytics, uses cookies to analyze traffic and interactions on this Site. These analytics and performance cookies are used on the Site, as further described below, only when you acknowledge a cookie banner on our Site. If you wish to opt out of the Google Analytics features that we use while using the Site on your web browser, you may do so by not acknowledging the cookie banner on our Site, using Google Analytics’s opt-out functions, which are available here (https://tools.google.com/dlpage/gaoptout). You may also be able to opt out of Google Analytics by selecting certain options in your Ads Settings or by using certain third-party applications and programs for indicating consumer consent.
    6. Our shopping services provider, Shopify, uses cookies in connection with providing their services to us and with analyzing traffic and interactions on this Site. These analytics and performance cookies are used on the Site, as further described below, only when you acknowledge the cookie banner on our Site.     7. Some browsers have incorporated “Do Not Track” (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. As of the date on which this Privacy Notice was last updated, however, there is no standardized DNT signal. As such, our Site does not currently respond to browser DNT signals. If you do not wish to be tracked, you may also be able to opt out by selecting certain options in the settings browser or device that you use to access the Site, or by using certain third-party applications and programs.
  3. USE OF INFORMATION WE COLLECT
    1. Operation and Improvement of our Site and Business. We use your information, including Personal Data, to operate our business and provide the Site and related Services to you. Where permitted by law, we may also use your information to develop new product features or Services and to improve the quality of our Services. Information that we collect about you will be retained for the periods authorized by applicable law.
    2. Responding to Communications. We use your information, including Personal Data, to respond to your communications to us, including communications submitted through the Site (such as through forms) or via email.
    3. Customer Service and Technical Support. We use your information, including Personal Data, in order to provide customer service and technical support for our Services. For example, we may send non-marketing and administrative communications to you from time to time in connection with topics like login issues.
    4. Advertising and Marketing. We may use your information, including Personal Data, to send you marketing communications or provide advertising promoting our Site, products or other Services. If you do not wish to receive such communications, you can choose to opt-out of receipt using the unsubscribe link within each communication. 
    5. Research. We may also use information about you to create and use anonymous, statistical or aggregated data. Such aggregated data does not allow any party to identify you or any other specific user, and is not Personal Data subject to this Privacy Notice. We may use such aggregated data in conjunction with information from other users in aggregate form, for our own internal research and analytical purposes, such as improving the quality of the Services, and for further internal, commercial and statistical purposes.
    6. For Enforcement of Agreements. We may use your information, including Personal Data, to carry out our obligations and enforce our rights under agreements between you and Bottango, or between Bottango and third parties.
    7. Security. We may use your information, including Personal Data, to investigate suspicious activity related to our Services, to enforce our Site policies, or as otherwise necessary to protect our legitimate interest in promoting the safety and security of our Site, systems, applications, and users.
    8. Complying with Legal Obligations. We may use your information, including Personal Data, when required to cooperate with public and government authorities, courts or regulators to the extent doing so requires the use or disclosure of information to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our Site, protecting our personal property or safety or that of third parties, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes, responding to lawful requests, or for auditing purposes.
    9. Other Authorized Purposes. We may use your information, including Personal Data, for any other purpose for which you have provided Bottango authorization to use the information.
  4. COMMUNICATIONS
    1. We send e-mails to persons who have provided their contact information to us directly and who have consented to receive communications from us. You may opt out of receiving marketing e-mail communications at any time by contacting us, or by clicking on the “Unsubscribe” link at the bottom of a marketing e-mail and following the instructions provided.
    2. Please note that even if you opt out of receiving promotional e-mails from us, you may still receive relationship e-mails from us, including responses to e-mails that you sent to us prior to opting out, notices of updates or changes to our policies and procedures, or other messages relating to your use of the Services. Additionally, because our system for processing opt-out requests is not automatic, your request may not be processed immediately. You may continue to receive some communications from us during the processing period.
  5. INFORMATION SHARING AND DISCLOSURE
    1. No Sale or Sharing of Personal Data. Bottango does not sell, rent, or lease your Personal Data to third parties, or share your Personal Data for cross-context behavioral advertising. We may, however, disclose some of your Personal Data to third parties on the terms and under the circumstances described in this Privacy Notice. If we determine that it is necessary and advisable to disclose your Personal Data, we may do so without notice to you.
    2. Upon Consent. We may provide your information, including Personal Data, to third parties if you provide us with authorization to do so or if necessary to provide you with services you’ve requested. Some features of our Services may provide you with the option to share information publicly or with specific third parties, in which case we would make such information available in accordance with the options you elect.
    3. Third-Party Service Providers. We may submit your information, including Personal Data, for processing by third-party service providers who assist us in providing the Site and related Services, and advertising and operating our business. This may include third-party service providers that provide shopping functionalities (currently Shopify), shipping services (currently Shopify, Pirate Ship, UPS, and USPS), web hosting (currently Shopify), subscription management, payment processing, customer research and analytics (including Shopify and Google Analytics), discussion groups or forums, and customer support. If we share your Personal Data with third-party service providers, we require those service providers to maintain the confidentiality of the Personal Data we provide to them, and to not use the Personal Data we share with them for purposes other than the services they are providing to us.
    4. Professional Advisors. We may disclose your information, including Personal Data, with professional advisors such as our lawyers, bankers, auditors, and insurers to the extent we are legally obliged to disclose such information or have a legitimate interest in sharing your Personal Data.
    5. Responses to Legal Process, Subpoenas or Court Orders. We may disclose your information, including Personal Data, as required by law, such as in response to a court order, subpoena, lawful demand by a public authority, or similar legal process.
    6. To Protect Our Business, Users or Others. We may disclose your information, including Personal Data, if we believe it is necessary to protect the property and/or rights of Bottango, you, or a third party, to protect the safety of the public or any person, in the event of a legal dispute, or to prevent or stop activity we believe may pose a risk of being illegal, unethical or in violation of the Terms of Use.
    7. Business Transfers. We may sell, assign, transfer or otherwise share some or all of our assets, including your Personal Data, in connection with a merger, acquisition, reorganization or sale of our assets or in the event of bankruptcy.
  6. POLICY REGARDING CHILDREN 
    1. Our Site and related Services are not intended for persons under 16 years of age, and we do not knowingly collect Personal Data from persons under 16 years of age. If you are a parent or guardian and believe that your child has provided us with Personal Data without your consent, please contact us at legal@bottango.com. If we become aware that a person under 16 years of age has provided us with Personal Data, we will take steps to delete such information from our systems.
  7. SECURITY 
    1. We follow generally accepted industry standards to protect the information we collect, maintain and transmit. We have in place commercially reasonable means designed to provide reasonable and appropriate administrative, technical and organizational security measures to protect your Personal Data against risks such as temporary or permanent loss, destruction, and unauthorized or unlawful access, alteration, use or disclosure. This includes, for example, firewalls, password protection and other access and authentication controls. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot, and do not, guarantee the security of any information you transmit to us, and you do so at your own risk. We also cannot, and do not, guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards.     2. If we learn of a security breach involving your Personal Data, we will inform you of the occurrence of the breach in accordance with applicable law.
  8. CHANGES TO THIS PRIVACY NOTICE 
    1. Bottango may modify this Privacy Notice from time to time to reflect changes in our practices, policies, technologies and legal requirements. If we modify this Privacy Notice, we will update the “Last Updated” notice at the top of this page. Any changes to this Privacy Notice are effective when we post the revised Privacy Notice on the Site. If any change to our Privacy Notice materially affects the use of your Personal Date, we will use reasonable efforts to notify you in advance, such as by sending an email (if you have provided Bottango with your email address) or by posting a prominent notice of the changes on the Site, and giving you a reasonable period of time to object to any changes. Objecting to changes may affect the availability of certain parts of the Site or the functionality of certain Services we can provide to you. Bottango will treat your continued use of Site after the effective date of any updated Privacy Notice as your acceptance of the Privacy Notice as revised. However, we will seek your affirmative consent to any material changes in our use of your Personal Data as described in a revised Privacy Notice if required by applicable data protection laws. You should review our Privacy Notice each time you access and use the Site.
  9. THIRD-PARTY WEBSITES AND SERVICES
    1. This Privacy Notice does not address, and Bottango is not responsible for, the policies and practices of third parties, including policies and practices related to privacy and security, data collection, processing, use, storage, and disclosure. This includes: (a) any third party operating a site or service to which the Services may link – the inclusion of a link in the Services does not imply endorsement of the linked site or service by Bottango; or (b) any app provider or social media platform provider (such as Facebook or Discord) - including any Personal Data you disclose to other organizations through or in connection with use of the Services.
  10. YOUR STATE PRIVACY RIGHTS 
    1. At this time, Bottango is not subject to the state-level data privacy laws of California, Connecticut, Colorado, Iowa, Virginia, or Utah. Note, however, that we do not share your Personal Data with third parties for their direct marketing purposes without your consent.
  11. EU GENERAL DATA PROTECTION REGULATION (“GDPR”) NOTICE
    1. Applicability. At this time, Bottango is not subject to the General Data Protection Regulation of the European Union or the United Kingdom.
    2. Transfer to United States. We are located in the United States. By submitting your Personal Data via our Site or through your interaction with the Site or Services, the Personal Data will be transferred to the United States.
